Terms & Conditions

These Terms & Conditions (“Terms”) govern all purchases of hydraulic presses, related components, customization services, and installation/maintenance support (collectively “Products/Services”) from PowerForge Hydraulics (“Company,” “we,” or “us”). By placing an order, signing a sales agreement, or accepting delivery of Products/Services, you (“Customer,” “you”) agree to these Terms, our Privacy Policy, and any attached technical specifications or project proposals.

1. Order Acceptance & Modifications

  • Your order (submitted via our website, email, phone, or in - person consultation) constitutes a request to purchase. We reserve the right to accept, reject, or adjust orders—e.g., due to component unavailability, customization feasibility issues, or regulatory compliance requirements for industrial equipment. A binding contract is formed only when we issue a signed “Sales & Service Agreement,” which includes product details, customization specs, pricing, delivery timelines, and service scopes.
  • Post - agreement modifications (e.g., adjusting press tonnage, adding automation features, or altering delivery locations) require a written “Change Order” signed by both parties. Modifications may increase costs (prorated based on materials, engineering labor, and rework) and extend timelines; we will provide a revised quote and timeline within 4 business days of your modification request.

2. Product Specifications & Compliance

  • All hydraulic presses and components meet industry standards (ISO 10243 for hydraulic press safety, ASTM A36 for structural steel frames) and local industrial safety regulations (e.g., OSHA standards in the U.S., CE marking requirements in the EU). We will provide detailed technical datasheets (including pressure capacity, dimensions, power requirements, and safety features) upon order confirmation; custom presses will include a signed engineering blueprint for your approval before production.
  • If your selected standard - model press is unavailable, we may substitute it with an equivalent or higher - performance alternative (with matching or better specs). We will notify you of substitutions at least 7 business days before production begins; you may cancel the order for a full refund if the substitute does not meet your operational needs.

3. Delivery & Installation

  • Delivery: Standard delivery includes curbside drop - off at your specified industrial facility. For oversized presses (over 5 tons), we will coordinate with specialized heavy - haul carriers; delivery costs (including permits for oversized loads) are outlined in the Sales & Service Agreement. You must ensure your facility has adequate access (e.g., wide entryways, reinforced flooring, and clearance for crane unloading if needed) to accept delivery. Delays due to insufficient site access will result in additional storage or redelivery fees.
  • Installation: Professional installation is required for all industrial - grade presses (100+ tons) and is optional for bench - top models (under 50 tons). Our certified technicians handle installation, including electrical wiring (per local codes), hydraulic line testing, and safety interlock setup. Installation timelines (3–7 business days for standard models, 10–14 days for custom units) may be extended by site - specific issues (e.g., incompatible electrical systems); we will notify you of delays within 24 hours and adjust schedules accordingly. Post - installation, we provide a “Commissioning Report” (including test results and safety certifications) and operator training (1–2 hours for standard models, 4–6 hours for custom/automated units).

4. Payment Terms

  • A 30% non - refundable deposit is required to confirm your order and initiate production/customization. The second installment (40%) is due upon completion of production (before shipment), and the final 30% is due within 5 business days of successful installation and commissioning (or delivery for self - installed models).
  • We accept wire transfers, commercial checks, and purchase orders (from approved businesses with net - 30 terms). Late payments incur a 2% monthly fee on the unpaid balance; failure to pay within 15 days of the due date may result in shipment/installation suspension or, for custom orders, retention of the press until full payment is received.
  • Customization fees (for engineering, blueprinting, and prototype testing) are non - refundable once design work begins (typically 5 business days after deposit receipt).

5. Warranties

  • Product Warranty: Standard hydraulic presses include a 2 - year warranty on all components (pumps, cylinders, valves) and a 5 - year warranty on structural frames (against bending or cracking under normal use). Custom presses include a 1.5 - year component warranty and 5 - year frame warranty. This warranty does not cover damage from misuse (e.g., exceeding rated tonnage), improper maintenance, or accidents.
  • Workmanship Warranty: We provide a 1 - year warranty on installation labor, covering issues like faulty hydraulic line connections or electrical wiring.
  • To claim warranty service, notify us within 10 days of discovering the issue; we will dispatch a technician (within 3–5 business days for domestic customers) to inspect the press. Repairs/replacements under warranty are free of charge (parts and labor); out - of - warranty service is billed at our standard hourly rate ($150/hour) plus parts costs.

6. Returns & Cancellations

  • Cancellations:
    • Before the Sales & Service Agreement is signed: Full refund of any deposit (if paid).
    • After the Agreement is signed but before production begins: Forfeiture of 10% of the total order value (to cover administrative and design costs).
    • After production begins (for standard models) or design finalization (for custom models): Forfeiture of the 30% deposit plus 20% of the remaining order value (to cover materials and labor already incurred).
  • Returns: Returns are only accepted for defective standard - model presses (reported within 7 days of delivery). Custom presses are non - returnable (due to their tailored design). For eligible returns, we arrange pickup and issue a refund (minus a 15% restocking fee) within 10 business days of inspecting the returned unit.

7. Limitation of Liability

  • We are not liable for indirect damages, including lost production revenue, downtime costs, or third - party claims, arising from delayed delivery, installation issues, or product defects (beyond warranty repairs/replacements). Our total liability for any claim shall not exceed the total amount paid for the Products/Services.
  • We are not responsible for damage to your facility or other equipment caused by improper use of the press, failure to follow safety guidelines, or pre - existing site conditions (e.g., inadequate flooring).

8. Governing Law & Disputes

  • These Terms are governed by the laws of the state/country where your facility is located. Disputes shall first be resolved through good - faith negotiation; if unresolved, disputes will proceed to binding arbitration (conducted by the International Chamber of Commerce for international customers or the American Arbitration Association for U.S. customers) instead of litigation.
